The Session starts in about a week and a half (Feb 5) and will move quickly so I thought I'd send out another update so you can get ahead of any of these bills that may interest you or your agency.
In addition to LC 263- Surety Bonds in lieu of Retainage- that I posted about last week, there is now another Legislative Concept floating around.
LC 218 - Defense Costs on Construction Agreements- Removes the ability for a public agency to have in A&E contracts the requirement that they pay for attorney fees or other defense costs incurred by the public body in defending a claim for professional negligence.
Additionally, there may also be another bill this session addressing cooperative procurements, but I haven't seen it yet.
I'll post more updates as the session gets underway.
With Gratitude,
Brian R. Smith, MPA, NIGP-CPP, CPPO, PMP
